TERMS AND CONDITIONS OF SPAIN-NEWS.ES
§ 1 Scope and Provider
(1) These General Terms and Conditions (hereinafter “T&C”) govern the contractual relationship between Blockchain Media Group SL (hereinafter “Spain-News.es” or “Provider”) and you (hereinafter “Customer”) in the version valid at the time of contract conclusion. (2) Deviating T&C of the Customer are not recognized. (3) Please read these T&C carefully before using the services of Spain-News.es. (4) Spain-News.es offers the following services:

Provision of partner links (pursuant to § 8)
§ 2 Conclusion of the Contract
(1) Contracts on this portal can only be concluded in English. (2) The Customer must be at least 18 years old. (3) Use of Spain-News.es services requires registration. (4) By registering, the Customer accepts these T&C. Registration establishes a contractual relationship between Spain-News.es and the Customer, governed by these T&C. (5) The presentation of services on the website does not constitute a binding offer but an invitation for the Customer to submit an offer. (6) By ordering a paid service, the Customer enters into a separate contractual relationship with Spain-News.es. Prior to conclusion, the Customer is informed about the scope of services, costs, and payment terms. The contractual relationship is established by confirming the order and payment obligation via the “order with payment obligation” button. (7) Invoices are provided electronically via email or in the Customer’s account. The Customer agrees to electronic invoicing. Information on the availability of electronic invoices is available on the website.
§ 3 Description of Service Scope
Spain-News.es provides online access to news and digital downloads (e.g., e-books, software) as part of premium memberships and subscriptions. Additionally, non-paid partner links are provided pursuant to § 8.
§ 4 Prices for Premium Services
(1) Basic use of Spain-News.es does not require registration. (2) For paid services, including premium memberships, subscriptions, and digital downloads, the Customer is informed in advance about costs, additional service scope, and payment terms. The provision of partner links pursuant to § 8 is free of charge. (3) The Provider may offer different pricing models and service scopes for different user groups, booking times, or usage periods.
§ 5 Payment Terms
(1) Fees are payable to Spain-News.es in advance at the due date without deduction. (2) By registering and using a paid service, the Customer authorizes the Provider to collect the due amounts. (3) Paid subscriptions automatically terminate at the end of the booked period. (4) Payments are collected upon purchase of the service. (5) The Provider may exclude certain payment methods. (6) Payments by cash or check are not permitted. (7) For online payment methods, the Customer authorizes the Provider to collect the due amounts at the time of the order. (8) For advance payment, the invoice amount must be transferred to the Provider’s account within five calendar days of order receipt. (9) If offered, the Customer authorizes the Provider to collect due amounts for credit card payments. (10) For direct debit payments, the Customer grants a SEPA Basic Mandate. The Customer bears the costs of chargebacks due to insufficient funds or incorrect bank details. (11) In case of payment default, the Provider reserves the right to claim default damages. (12) Payments are possible via the following payment methods:

§ 6 Registration and Termination
(1) The Customer may deregister at any time without stating reasons by email. Alternatively, the Customer can deactivate their account in the user area, terminating the contractual relationship. (2) Paid subscriptions can be terminated no later than 10 days before the end of the booked period. Late termination extends the subscription by the booked period. Terminations can be made via email, phone, or letter and will be confirmed in writing. Name, email address, and postal address must be provided for identification. (3) Spain-News.es may terminate the contractual relationship at any time without stating reasons and remove the Customer’s profiles or content without obligation to inform the Customer. (4) After termination, Spain-News.es may inform other users likely in contact with the Customer about the termination, without implying statements about the Customer’s character or reputation. (5) False or fraudulent information in the profile or on the portal may lead to civil law consequences. The Provider may terminate the contract immediately in such cases. (6) In case of account suspension or termination due to a breach of contract, the Customer shall pay damages equal to the agreed fee for the remaining term, minus 10% saved expenses. Higher or lower damages or expenses can be proven by either party. (7) Upon termination, the Customer’s data will be deleted upon request.
§ 7 Limitation of Liability (Services)
(1) Spain-News.es assumes no responsibility for the accuracy of registration, profile, or other user data. (2) Contracts for services are concluded solely between the involved Customers. Spain-News.es is not liable for Customers’ services or related matters, such as received services or due payments, and rejects any liability claims in this regard. (3) For damages resulting from injury to life, body, or health, Spain-News.es is liable only for intentional or negligent breaches of duty by Spain-News.es, its legal representatives, or vicarious agents. (4) For other damages, Spain-News.es is liable only for intentional or grossly negligent breaches of cardinal obligations by Spain-News.es, its legal representatives, or vicarious agents. (5) Damage claims are limited to foreseeable, contract-typical damages and, in case of default, to a maximum of 5% of the order value. (6) Claims for injury to life, body, health, or freedom expire after 30 years; other claims expire after one year from knowledge or grossly negligent ignorance of the claim basis. (7) Spain-News.es may review content or uploaded files for legal compliance and delete them in whole or in part in case of violations. (8) Premium members may use content behind the paywall solely for personal use and not against the author, particularly not for advertisements, accusations, or actions that could harm the author.
§ 8 Affiliate Programs and Digital Content
(1) Affiliate Programs Spain-News.es may participate in affiliate programs and earn commissions for purchases or actions via special links. Affiliate links are marked to the best of knowledge. No additional costs arise for users. Spain-News.es assumes no liability for third-party products or services. Users are obliged to review the T&C and privacy policies of third-party providers. Spain-News.es may modify or terminate participation in affiliate programs at any time.
(2) Digital Content as Download Upon successful download of digital content (e.g., e-books, software), the user receives a non-exclusive, temporally and spatially unlimited right of use for private purposes. The right of withdrawal expires upon starting the download, as digital content is non-returnable. Exchange or return is excluded, except for defects for which Spain-News.es is responsible, in which case statutory defect rights apply. Users are responsible for technical requirements (e.g., storage space, compatible software).
§ 9 Set-off and Right of Retention
(1) The Customer may only set off against legally established or undisputed counterclaims. (2) The Customer may exercise a right of retention only if their counterclaim arises from the same contractual relationship.
§ 10 Right of Withdrawal
(1) Consumers have a right of withdrawal as follows: (2) Right of Withdrawal You have the right to withdraw from this contract within three days without stating reasons. The withdrawal period is three days from the conclusion of the contract. We will confirm receipt of the withdrawal immediately (e.g., via email). Sending the withdrawal before the expiry of the period is sufficient to meet the deadline.
(3) Consequences of Withdrawal Upon withdrawal, we will refund all payments received from you promptly, no later than fourteen days from receipt of the withdrawal notice, using the same payment method you used, unless otherwise agreed. No costs will arise for you. If you requested that the service begin during the withdrawal period, you shall pay a reasonable amount for the services already provided in proportion to the total scope of the contractually agreed services.
(4) Exceptions to the Right of Withdrawal The right of withdrawal expires for:

Fully performed services, if you agreed in advance that performance begins and the right of withdrawal expires upon full performance;

Delivery of newspapers, magazines, or periodicals, except for subscription contracts;

Digital content, as soon as the download begins.

§ 12 Newsletter Subscription
By actively using our chatbot, registering as a member, purchasing digital content, or consciously entering your email address in designated fields on our website, you expressly consent to receiving our regular newsletter. This informs you about current offers, new content, and interesting news about our products and services. Your consent to receiving the newsletter is voluntary and can be revoked at any time. Unsubscribing is straightforward via the link provided in each newsletter email. After successful unsubscription, you will no longer receive newsletters from us.
§ 13 Jurisdiction and Applicable Law
(1) Disputes arising from this contract are governed exclusively by Spanish law, excluding the UN Convention on Contracts for the International Sale of Goods. (2) The place of jurisdiction for merchants, legal entities under public law, or special funds under public law is the Provider’s registered office.
§ 14 Final Provisions
(1) The contract language is English. (2) Minors may use Spain-News.es only with the consent of a legal guardian. (3) Failure to take action in case of a breach of these T&C does not impair our right to take action for subsequent breaches. (4) We may modify our website, rules, and T&C at any time. The T&C valid at the time of your order apply to your order, unless a change is required by law or regulation. (5) The invalidity of one provision does not affect the validity of the remaining provisions. An invalid provision will be replaced by a legally permissible provision that comes as close as possible to the economic purpose of the invalid provision.
